1 – Acceptance of the conditions
The customer acknowledges having read, at the time of placing the order, the special conditions of sale stated on this screen and expressly declares accepting them without reservation.
The present general conditions of sale regulate the contractual relations between Pastels Girault SAS and its customer, both parties accepting them unreservedly. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.
2 – Products
The pictures illustrating the products are not part of the contract. In the event of errors, we will ensure that they are rectified as soon as possible. Most of the products offered by Pastels Girault SAS are available in our workshop.
In very rare cases, certain shades may be substituted by a more similar value if stock levels require it.
3 – Order
The automatic registration systems are regarded as being worth proof, of the nature, the contents and the date of the order. PASTELS GIRAULT confirms acceptation of its order to the customer on the email address that this one would have communicated. The sale will not be concluded until the order has been confirmed. PASTELS GIRAULT reserves the right to cancel any order of any customer with who would a litigation in relation with the payment of a former order exist. The information stated by the buyer, at the time of the order engages this one: in case of error in the wording of the contact details of the recipient, the seller could not be held responsible for the impossibility to deliver the product in which he could be.
Orders for “pastels unity” (shades of customer choice), are for a minimum of 5 pastels.
4 – Delivery
After order confirmation, Pastels Girault SAS undertakes to hand over to its carrier all the items ordered by the buyer within a maximum of 7 working days for mainland France, or 14 working days for countries within the European zone.
Delivery is made either by direct handover of the product to the buyer, by notice of availability, or by delivery to a shipping agent or carrier.
The buyer must check the goods upon receipt.
In the event of damage, missing items, complaints regarding visible defects or the non-conformity of the delivered product, the buyer must express clear and precise reservations within three days following the delivery date, in writing to the seller or the carrier. It is the buyer’s responsibility to provide any proof of the anomalies observed.
For deliveries outside mainland France, the customer agrees to pay all taxes related to the import of the products, including customs duties, VAT, and any other applicable taxes under the laws of the country where the order is received.
All orders placed with Pastels Girault SAS are for the personal use of the customers; customers or recipients of the products shall refrain from any partial or total resale of the products.
Pastels Girault SAS shall be released from any legal liability if the customer fails to pay the required taxes.
Deliveries are made by La Poste via tracked Colissimo service.
In the event of visible defects, the buyer has the right to return the product under the conditions specified in this document.
Events considered as force majeure releasing the seller from its delivery obligation include war, riots, fire, strikes, accidents, and supply shortages. Goods always travel at the recipient’s risk. Always check your package upon arrival. You have 48 hours to notify the carrier of any damage or missing items.
For availability reasons, an order may be delivered in several shipments. In such cases, the customer is charged only once for delivery. If the customer wishes to have products delivered to two different addresses, they must place two separate orders, each with its own shipping charges.
5 – Retraction
You have 14 days as from the reception of the items (except Sundays and National days off) to make your opinion. In case of exchange or refunding, return the item in its original packaging, intact, accompanied by all the possible accessories, instructions and documentations to the following address:

In case of use of the right of retraction, is held with the refunding of the sums paid by the customer, without expenses, except the expenses of return. Refunding is due within 15 maximum days.
6 – Price
The price is listed in euros.
The price shown on the product pages does not include shipping, taxes, or customs fees specific to each country.
Free shipping may be offered and applied when applicable, but only within mainland France (for orders of at least €100 delivered to a pickup point).
The price indicated in the confirmation of order is the final price, expressed all taxes included and including the VAT for the countries of the EU. The companies of the EU wishing a refund of the amount of the VAT must indicate to us their VAT Number and provide us with an official document of their VAT Number.
This price includes the price of the products, the handling charges, packaging and conservation of the products, the transport charges.
7 – Payment
The price charged to the customer is the price indicated on the order confirmation sent by Pastels Girault SAS.
The price of the products is payable in cash on the day of the effective order.
Payment can be made by credit card bearing the CB logo, by bank transfer, or by sending a bank check with the order.
Online E-transaction allows you to make payment through a bank server linked to Crédit Agricole in a secure environment. Your credit card number is therefore directed to the bank’s servers, and your payment is made directly to a bank in a secure environment without going through the store’s server. This guarantee is even more important because your card information is known only to our banking partner (CREDIT AGRICOLE).
The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval. In case of refusal by these payment centers, the order will be automatically canceled, and the customer will be notified by email. Furthermore, Pastels Girault SAS reserves the right to refuse any order from a customer with whom there is a dispute.”
8 – Litigations
This contract is subjected to the French right. PASTELS GIRAULT cannot be charged for the damage of any nature, material, immaterial or corporal, which could result of a faulty operation or from the misuse of the sold products. It is the same for the possible modifications of products resulting from the manufacturers. The responsibility of PASTELS GIRAULT will be, in any event, limited to the amount of the order and could not be blamed for simple errors or omissions which could have remained despite everything the precautions taken in the presentation of the products. In the event of difficulties in application of this contract, the buyer has the possibility, before any action in Courts, to seek a friendly solution with the help of: a trade association of the branch, an association of consumers or any other council of his choice. One is reminded that the search for the friendly solution does not interrupt the “short time” legal guarantee, nor contractual warranty period. It is pointed out that in general rule and subject to the appreciation of the Courts; the respect of the provisions of this contract relating to the contractual guarantee supposes that the buyer honours his financial commitments towards the seller.
The complaints or disputes will be always received with attentive benevolence, the good faith being always supposed at who takes the pain to explain its situations.
In the event of litigation, the customer will treat by priority with the company to obtain a friendly solution.
If needed, the Commercial Court of Perigueux is the only qualified whatever the place of delivery and the mean of payment accepted.
9 – Warrantee
PASTELS GIRAULT guarantees to you that all the selected products are manufactured or produced or published in France. In all the cases PASTELS GIRAULT could not be charged for non respect of the regulations and legislation in practice in the country of reception. The responsibility of PASTELS GIRAULT is systematically limited to the value of the product blamed, value on its date of sale and that without any possibilities of recourse towards the mark or the producing company of the product.
In any assumption, the customer benefits from the legal eviction and the hidden defects warrantee (Art.1625 and following of the civil code). With the condition that the buyer makes the proof of the hidden defect, the seller must legally repair all the consequences (art.1641 and following of the civil code); if the buyer goes to Court, he must do it in a “short time” as from the discovery of the hidden defect (art.1648 of the civil code). 10 – Legal information
The collect of personal information for online sales is compulsory, this information being essential for the treatment and sending of orders, establishment of the invoices and contracts of warrantee. The defect of information involves an invalid order. In accordance with the law “Data processing and Freedoms”, the personal data processing relating to the customers made the object of a declaration to the National Commission of Computing and Freedoms (CNIL). The customer has a right of access, of modification, correction and suppression of the data related to him (article 34 of the law of January 6, 1978), he can carry by PASTELS GIRAULT. Moreover, PASTELS GIRAULT ensure not to communicate, for free or with financial counterpart, the contact details of its customers to a third.
